Australia Business Development- Provisional

These visas, known as Business Skills visas, are for business people to establish a business in Australia, manage a new or existing business or invest in Australia. All except the Investor Retirement visa offer a pathway to permanent residence.

For business people to establish a business in Australia, manage a new or existing business or invest in Australia. These are temporary visas that offer a pathway to a permanent visa (except for the Subclass 405 – Investor Retirement visa).

Business Skills Visas are further divided into following categories:

1. Business Owners

Business Owner (Provisional) (Subclass 160)

This visa is for people who have a successful business career, and have a genuine and realistic commitment to be involved as an owner in a new or existing business in Australia. This visa is also the first step towards being granted a permanent Business Skills visa.

With this visa you can:

  • establish a new or existing business in Australia
  • travel in and out of Australia any number of times as long as the visa is valid
  • Have your family accompany you to Australia. They will have access to work and study rights
  • establish a pathway to permanent residence

State/Territory Sponsored Business Owner (Provisional) (Subclass 163)

This visa is forpeople sponsored by a state or territory of Australia. Applicants must have a successful business career, and a genuine and realistic commitment to be involved as an owner in a new or existing business in Australia. This visa is also the first step towards being granted a permanent Business Skills visa.

With this visa you can:

  • establish a new or existing business in Australia
  • travel in and out of Australia any number of times as long as the visa is valid
  • have your family accompany you to Australia. They will have access to work and study rights
  • establish a pathway to permanent residence

2. Senior Executives

Senior Executives (Provisional) (Subclass 161)

This visa is for senior executive employees of major overseas businesses, who have significant net assets and a genuine and realistic commitment to participate in the management of a new or existing business. This visa is also the first step towards being granted a permanent Business Skills visa.

With this visa you can:

  • establish a new or existing business in Australia
  • travel in and out of Australia any number of times as long as the visa is valid
  • have your family accompany you to Australia. They will have access to work and study rights. Your family includes your partner and any dependants

State/Territory Sponsored Senior Executive (Provisional) (Subclass 164)

This visa is designed is for senior executive employees of major overseas businesses, who have significant net assets and a genuine and realistic commitment to participate in the management of a new or existing business. This visa is also the first step towards being granted a permanent Business Skills visa.

With this visa you can:

  • establish a new or existing business in Australia
  • travel in and out of Australia any number of times as long as the visa is valid
  • have your family accompany you to Australia. They will have access to work and study rights. Your family includes your partner and any dependants.

3. Investors

Investor (Provisional) (Subclass 162)

This visa is for people who have a successful business or investment career, and have a genuine and realistic commitment to be involved in investing or business in Australia. This visa is also the first step towards being granted a permanent Business Skills visa.

With this visa you can:

  • make a designated investment
  • travel in and out of Australia any number of times as long as the visa is valid
  • have your family accompany you to Australia. They will have access to work and study rights
  • establish a pathway to permanent residence.

State/Territory Sponsored Investor (Provisional) (Subclass 165)

This visa is for people who have a successful business or investment career, and have a genuine and realistic commitment to be involved in investing or business in Australia. This visa is also the first step towards being granted a permanent Business Skills visa.

With this visa you can:

  • make a designated investment
  • travel in and out of Australia any number of times as long as the visa is valid
  • have your family accompany you to Australia. They will have access to work and study rights
  • establish a pathway to permanent residence

Investor Retirement Visa (Subclass 405)

The Investor retirement visa is a temporary visa that allows you to stay in Australia for four years. There is an option to apply for further Investor retirement visas which will allow you to stay for a further four years, however you will need to meet the requirements to be granted a subsequent visa. As long as you continue to satisfy the visa requirements you can keep applying for subsequent Investor Retirement visas.

4. Independent Executives

Independent Executive Further Application Onshore (Subclass 457IEFAO)

This visa was developed in recognition that an emerging number of Independent Executive visa holders in Australia were facing expiry of their visa, but were legitimately in Australia and required time to be eligible to apply for permanent residence under the:

  • Established Business in Australia (Subclass 845)
  • Regional Established Business in Australia (Subclass 846)
  • State/Territory Sponsored Business Owner (residence) (Subclass 892)

This visa is only for existing holders of a Temporary Business (Long Stay) Independent Executive visa (Subclass 457IE) who need more time to be eligible to apply for one of the visas listed above.

New applicants for subclass 457 visas should apply for a Temporary Business (Long Stay) - Standard Business Sponsorship.

This visa allows you to:

  • remain in Australia to continue business activities as an owner
  • leave and re-enter Australia as long as the visa is valid
